Welding kits and digital design files

These Terms of Sale ("Agreement") govern your purchase of physical welding kits ("Kits") and digital design files such as DXFs, STEPs, drawings, and FeatureScripts ("Files") from Weldigami ("we", "us"). By placing an order, you confirm that you are of legal age in your jurisdiction (and at least 18 years old) and you agree to this Agreement. If you do not agree, do not place an order.
1. Definitions
- Kit: a set of laser-cut steel parts and any included hardware, sold for the buyer to weld and assemble.
- File: a digital design asset (DXF, STEP, drawing, FeatureScript, or similar) licensed for the buyer to fabricate or use in their own CAD work.
- Buyer / you: the individual or entity placing the order.
2. Orders and Acceptance
All orders are offers to purchase, subject to our acceptance. We may decline or cancel any order before shipment or delivery, including for pricing errors, stock issues, or suspected fraud. A confirmation email acknowledges receipt of your order; acceptance occurs when we ship the Kit or deliver the File.
3. Pricing and Payment
Prices are listed in U.S. dollars and exclude taxes, duties, and shipping unless stated. Payment is due in full at checkout. Prices are subject to change without notice; the price applied to your order is the price displayed at checkout when the order is placed. We reserve the right to correct pricing or description errors and to cancel any affected order even after acceptance, with a full refund of amounts paid.
4. Production and Lead Times
Many Kits are made to order. Lead times shown at checkout are estimates and not guaranteed. We are not liable for delays caused by suppliers, carriers, or events outside our reasonable control.
5. Shipping and Risk of Loss
We ship to the address provided at checkout. Risk of loss passes to you when the carrier takes possession of the Kit. Title to Files passes on delivery of a download link or file transfer.
6. Inspection and Damage in Transit
Inspect Kits on receipt. Report shipping damage or shortages in writing within seven (7) days of delivery, with photos. Claims made after seven days may not be honored.
7. Returns and Refunds
- Standard Kits: returns accepted within fourteen (14) days of delivery, unused and in original packaging. Buyer pays return shipping; a restocking fee may apply.
- Made-to-order or custom Kits: non-returnable except for defects in materials or workmanship.
- Files: digital purchases are non-refundable once delivered or downloaded.
- Defects: if a Kit has a manufacturing defect, contact us within thirty (30) days of delivery for replacement of the affected parts at our discretion.
8. License Grant for Files
We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Files for your own fabrication, prototyping, and end-use products, including small-scale commercial use by your business or workshop.
You may not:
- Resell, redistribute, share, or publish the Files in any form, modified or unmodified.
- Use the Files to produce parts for resale as the design itself (i.e., reselling the design as a Kit or pattern).
- Use the Files to train machine-learning models or generative systems.
- Remove or alter copyright notices embedded in the Files.
We retain all intellectual-property rights in the Files. No rights are granted except as stated above. Your license to a File terminates automatically if you breach this Section; on termination, you must delete all copies of the File in your possession.
9. Assumption of Risk — Welding, Fabrication, and Use
Welding, cutting, grinding, and assembling steel parts involve serious hazards including burns, fire, eye injury, electrical shock, fume inhalation, and structural failure of finished assemblies. By purchasing a Kit or File, you acknowledge and agree that:
- You are solely responsible for using appropriate personal protective equipment, ventilation, fire safety, and welding technique.
- You will follow all applicable manufacturer instructions, OSHA / local safety regulations, and welding-code requirements.
- You will only attempt fabrication if you are qualified to do so or working under qualified supervision.
- You assume all risk of injury, property damage, or loss arising from fabrication, assembly, or use of any product made from a Kit or File.
10. Intended Use and Limitations
Kits and Files are sold for general fabrication and workshop use. They are not rated, certified, or designed for:
- Pressure vessels, piping, or fluid containment.
- Structural building applications requiring engineering certification.
- Lifting, rigging, or load-bearing safety equipment.
- Aerospace, marine, automotive safety systems, medical devices, or any life-safety application.
You are responsible for verifying suitability for your intended use, including engineering review and code compliance.
11. Modifications by Buyer
Once a Kit is welded, cut, drilled, or otherwise modified, it is considered final. Modifications void any defect-replacement remedy under Section 7.
12. Disclaimers
EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, KITS AND FILES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELDIGAMI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that Files are error-free or suitable for any particular fabrication process, machine, or material grade.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELDIGAMI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR PURCHASE OR USE OF KITS OR FILES.
WELDIGAMI'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE KIT OR FILE GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law.
14. Indemnification
You agree to indemnify and hold harmless Weldigami, its owners, and affiliates from any claims, damages, or liabilities arising from your fabrication, assembly, modification, sale, or use of any product made from a Kit or File, or from your violation of this Agreement.
15. Force Majeure
We are not liable for delays or failures to perform caused by events outside our reasonable control, including supplier shortages, carrier delays, equipment failure, labor disputes, natural disasters, or government actions.
16. Changes
We may update this Agreement. Orders placed after changes take effect are governed by the updated terms. Orders already placed are governed by the terms in effect at the time of order.
17. Governing Law and Disputes
This Agreement is governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any disputes arising under this Agreement shall be brought in the state or federal courts located in North Carolina, and you consent to that jurisdiction.
18. Severability
If any provision of this Agreement is held to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
This Agreement, together with any order confirmation and our published Privacy Policy, constitutes the entire agreement between you and Weldigami regarding the purchase of Kits and Files, and supersedes any prior communications or agreements on the subject. Failure to enforce any right under this Agreement is not a waiver of that right.
